David S. Wayne

Mr. Wayne is a Partner in Arnstein & Lehr’s Litigation Group. He practices in a variety of areas including complex real estate and commercial litigation, employment and labor, insurance coverage, products liability and construction litigation. His practice includes all aspects of litigation including trial work, arbitration/mediation, appeals, motion practice, and responding to charges before state and federal agencies such as the National Labor Relations Board, and the Equal Employment Opportunity Commission. Mr. Wayne has successfully litigated cases to judgment in Illinois state and federal courts, as well as to award before the American Arbitration Association. Significant recent victories include obtaining a judgment in favor of a client who was sued by his business partner to restrain the sale of a large, multiunit apartment building, successfully defending (at the trial and appellate courts) a client/developer in a fraud action in connection with the sale of real estate, and obtaining a finding of no liability on behalf of a national retainer in an action involving a natural gas explosion.

Mr. Wayne also handles non-litigation matters including, among others, successfully negotiating collective bargaining agreements with labor unions in a variety of industries, including manufacturing and condominium associations, drafting and negotiating numerous employment contracts and severance agreements for a wide-range of industries and professions, and assisting businesses in resolving disputes among partners and shareholders.

Professional Activities and Achievements

Mr. Wayne is a member of the Chicago Bar Association. In addition, while in law school he served as Editor-At-Large for the Loyola Law Review and was a founding member and officer of the Loyola Employment Law Society.  Mr. Wayne serves as Vice President of the Professional Board for PAWS (“Pets Are Worth Saving”) Chicago.

Mr. Wayne recently authored a blog posting for Arnstein & Lehr’s employment law blog, General-Counselor.com, entitled “Use of the Internet in Trade Secret Cases.”
