Andrea Cox

Andrea Cox is a partner in Arnstein & Lehr’s Litigation Department. Her trial practice is state-wide and focuses on helping business owners involved in contract disputes and defending manufacturers in product liability suits. Ms. Cox has experience in all aspects of litigation, from pre-trial discovery through appeal. She regularly advocates for her clients in trial court and binding arbitration, particularly on motions to dismiss and motions for summary judgment.

Ms. Cox is Board Certified in Appellate Practice. She has extensive experience in state and federal appellate courts, representing clients in product liability, contract, securities, and defamation cases. Ms. Cox has argued before the Florida Supreme Court and the U.S. Eleventh Circuit Court of Appeals.

Professional Activities and Achievements

Ms. Cox is a member of the Rosemary Barkett Appellate Inn of Court.  She serves as a guest judge for the University of Miami Moot Court competition and Florida International University mock trial competition, and volunteers as a mentor to high school and college students interested in pursuing legal careers.

Ms. Cox is a member of the Defense Research Institute, Women’s Fund of Miami-Dade, Florida Association of Women Lawyers, and Florida Bar Appellate Practice Section.

Recent Appellate Decisions

Bamert v. Pulte Home Corp., 2011 WL 5105925 (11th Cir. 2011): Successful appeal on behalf of 38 plaintiffs of order dismissing securities claims on the grounds that purchases were not investment contracts under S.E.C. v. Howey.

NITV, LLC v. Baker, 61 So.3d 1249 (Fla. 4th DCA 2011): Reversal of judgment for $325,000 in economic damages in defamation action.

The Gencom Group v. Garcia Stromberg LLC , 34 So.3d 170 (Fla. 3d DCA 2010): Successful Petition for Writ of Mandamus for hotel developer where appellate court required trial court to rule on whether a commercial dispute is subject to arbitration.

Vos B.V. v. Payen, 15 So.3d 734 (Fla. 3d DCA 2009): Reversal of order in a product liability action finding personal jurisdiction over Dutch Corporation with de minimus contacts in Florida.

Cordis Corporation and Johnson & Johnson  v. O’Shea, 988 So.2d 1163 (Fla. 4th DCA 2008): Successful Petition for Writ of Certiorari on question of first impression regarding sharing provisions in confidentiality agreements.
